Case examples include:
- Instructed by a company director to successfully defend a claim by liquidators for in excess of £15 million, for alleged breach of fiduciary duties and misfeasance in a cross border claim.
- Acted for a company and its directors to resolve multiple claims, and have statutory demands served on the company and on the directors personally set aside, through court proceedings and without prejudice negotiations.
- Represented the trustee in bankruptcy of a director who was liable to the liquidator of a company £450 million following a High Court order. Legal issues included misfeasance, fraud and an off-shore hedge fund. Took steps to recover part of the debt against the bankrupt’s personal assets and obtained orders to set aside charges registered against a property in favour of third parties and family members as a preference.
- Acted for individual agricultural clients to resolve a complex boundary dispute and to obtain a costs order in their favour.
- Acted for respondents to successfully resolve a claim by a trustee in bankruptcy in a complicated trust litigation case. Issues included partnership law, trusts and fraud with assets up to a value of £10 million.
- Represented two directors in defending Company Directors Disqualification proceedings. Case against the directors was withdrawn and a costs order was made in their favour.
